Zync Render Terms of Service

Please note that these terms of service rely on Version 2.0 of the Google Cloud Data Processing and Security Terms, which go into effect as of 25 May 2018 (when the EU’s General Data Protection Regulation comes into force). These terms of service will replace the original Zync Terms of Service as of 25 May 2018. By accepting these terms, you agree to both versions.

  1. Applicable Terms. The Zync Render Terms of Service (“Zync ToS”) apply to a service that provides image rendering of third-party software applications ("Zync Rendering").
    1. The Zync ToS consists of: (i) the Google Cloud Platform Terms of Service ("Google Cloud ToS") and the terms below. If there is a conflict between the terms below and the Google Cloud ToS, the terms below will prevail.
    2. By clicking to accept the Zync ToS or using Zync Rendering, you agree to these terms.
    3. By accepting the Zync ToS on behalf of Customer, you warrant that: (a) you have the full legal authority to bind Customer to the Zync ToS; (b) you have read and understand the Zync ToS; and (c) you agree, on behalf of Customer, to the Zync ToS. If you do not have the legal authority to bind Customer, please do not accept the Zync ToS.
  2. Service Specific Terms.
    1. Section 1.8 (Service Specific Terms and Data Processing and Security Terms) of the Google Cloud ToS is replaced entirely with the following: “The Service Specific Terms and Data Processing and Security Terms are incorporated by this reference into the Agreement, except for the exceptions to the Service Specific Terms and exceptions to the Data Processing and Security Terms in the Service Specific Terms in the Zync Render Terms of Service.”
    2. Sections 7.1.3, 7.1.4.b, and 8.a of v2.0 the Data Processing and Security Terms are deleted in their entirety.
  3. Service. Zync Rendering is a "Service" as defined in the Google Cloud ToS. You may not separate any component of the Service from the Service as a whole, and you may not host any third-party software APIs used via Zync Rendering on your own servers.
  4. Zync Admin Console. As part of Zync Rendering, you will have access to an online console solely for administering your use of Zync Rendering as an “Admin Console” as defined in the Google Cloud ToS.
  5. Fees. The applicable Zync Rendering Fees are listed at http://www.zyncrender.com/#pricing, which may be updated from time to time.
  6. Third-Party Reporting Requirements. Google may provide your name, contact information, and quantity of your Zync Rendering and your independent, third-party software use on Zync Rendering to these independent, third-party software providers who license their software for use with Zync Rendering. Our current independent, third-party software vendors are listed at https://zyncrender.com/#about.
  7. Pre-Release Software. SOME THIRD-PARTY SOFTWARE HAS NOT BEEN FULLY TESTED ("PRE-RELEASE SOFTWARE") AND MAY CONTAIN DEFECTS OR DEFICIENCIES THAT MAY NOT BE CORRECTED. PRE-RELEASE SOFTWARE MAY UNDERGO SIGNIFICANT CHANGES PRIOR TO RELEASE OF THE GENERALLY AVAILABLE FINAL VERSION AND THE GENERALLY AVAILABLE FINAL VERSION MAY NOT CONTAIN CERTAIN FEATURES OR FUNCTIONALITY THAT ARE CONTAINED IN THE PRE-RELEASE SOFTWARE. SUPPLIERS WILL HAVE NO OBLIGATION TO RELEASE ANY PRODUCT OR MAKE AVAILABLE ANY SERVICE BASED ON PRE-RELEASE SOFTWARE.
  8. Our Use of Zync Rendering Data. We may collect information such as how Zync Rendering is used, and how and what errors occur from both the Zync application and independent, third-party software. We may use this data to improve, maintain, protect and develop Zync Rendering as described in our privacy policy.
  9. Feedback. If Customer provides Google with Feedback about the Services, then Google may share that Feedback with the independent, third-party software providers who license their software for use with Zync Rendering. By providing the Feedback, Customer assigns to Google all right, title, and interest in that Feedback. Google and those third-party software providers may use that Feedback without obligation to Customer.
  10. Technical Support. Google may need to share certain Customer data with independent, third-party software providers (“ISVs”) who license their software for use with Zync Rendering in order for them to provide technical support services to Customer. Customer grants to Google the right to share Customer data with an ISV for this purpose. Customer (a) acknowledges that Customer data shared with the ISV may be subject to the ISVs terms of service and privacy policy and (b) agrees that Google is not responsible for the ISV maintaining the safety, security or privacy of such Customer data shared with the ISV.
